By subscribing to ThriveTools OPT, you agree to provide accurate and up-to-date payment information and authorize ThriveTools OPT to charge your chosen payment method for all applicable subscription fees, taxes, and additional charges. Payments are processed securely through Stripe, a PCI-compliant payment gateway. ThriveTools OPT does not store your full payment details, and all transactions are encrypted for security. You are responsible for ensuring that your payment information remains valid and current to avoid disruptions in service. If your payment method is declined or invalid, your account may be suspended or terminated until the issue is resolved. All subscription fees are billed in U.S. Dollars (USD) unless otherwise specified, and subscription plans are offered on a recurring basis. By signing up for a subscription, you agree to recurring billing according to the plan you select. Fees for the selected plan will be charged at the start of each billing cycle and are non-refundable unless otherwise stated in our Refund Policy or required by law. ThriveTools OPT reserves the right to modify subscription pricing, features, or plans with at least 30 days’ notice provided via email or on the platform. Continued use of the platform after the notice period constitutes acceptance of the updated pricing. Refunds are only issued under specific circumstances, such as billing errors or situations where the platform fails to deliver services as outlined. Users seeking refunds must contact support at contact@optimize.thrivetools.io with a detailed explanation of the issue and supporting documentation, if applicable. Refund requests must be submitted within 7 days of the billing date to be considered. Refunds will not be issued for dissatisfaction after substantial use of the platform, failure to cancel before renewal, or violations of the Terms. ThriveTools OPT does not provide refunds for unused portions of a subscription or for limitations clearly stated during the purchase process. By creating an account on ThriveTools OPT, you agree to use the platform in accordance with these Terms, our Acceptable Use Policy (AUP), and all applicable laws. You must not use ThriveTools OPT for activities that violate local, national, or international laws, infringe on the rights of others, or disrupt the functionality of the platform. Prohibited activities include, but are not limited to, uploading malicious files, attempting to gain unauthorized access to the platform, using the platform to store or distribute unlawful content, or engaging in fraudulent or unethical practices. ThriveTools OPT reserves the right to monitor usage to ensure compliance with these Terms and the AUP. Users are required to respect the platform’s technical limitations, including storage and API request limits defined by their subscription plan. Exceeding these limits without upgrading to a higher-tier plan may result in restricted access to certain features. Users are also prohibited from attempting to bypass these limitations or using automation tools that interfere with the platform's performance. Account sharing, including sharing login credentials with unauthorized individuals or third parties, is strictly prohibited. Each subscription plan is intended for use by a single individual or authorized business entity, depending on the plan type. Unauthorized account sharing may result in immediate suspension or termination of the account without refund. Users must also notify ThriveTools OPT immediately at contact@optimize.thrivetools.io if they suspect unauthorized access to their account or a breach of security. In addition to compliance with these Terms, users agree to adhere to basic principles of conduct when interacting with other users or ThriveTools OPT staff. Harassment, abusive language, or any form of harmful behavior will not be tolerated and may lead to account suspension or termination. All content, software, tools, and materials provided by ThriveTools OPT, including but not limited to images, text, designs, algorithms, and features, are the intellectual property of ThriveTools OPT and are protected under copyright, trademark, and other applicable intellectual property laws. By using the platform, you are granted a limited, non-exclusive, non-transferable, and revocable license to access and use the services for their intended purposes, as defined by your subscription plan. This license does not confer ownership or any rights to modify, reproduce, or distribute any part of the platform without prior written consent. You retain ownership of any images, data, or content you upload to the platform for processing. ThriveTools OPT does not claim ownership over your uploaded content, but by using the platform, you grant us a temporary, non-exclusive license to process and optimize your images in accordance with the functionality of the platform. This license is automatically revoked once the processing is complete, and ThriveTools OPT does not store your uploaded files beyond the limits of your plan unless explicitly required to do so for troubleshooting or compliance purposes. Users are prohibited from reverse-engineering, decompiling, or disassembling the platform or any of its components. Any attempt to extract source code, algorithms, or proprietary processes constitutes a violation of these Terms and may result in immediate suspension or termination of your account, as well as legal action. ThriveTools OPT reserves the right to use anonymized and aggregated data for the purposes of improving platform performance, analytics, and product development. Such data will never include personally identifiable information or the contents of your uploaded images. This includes but is not limited to loss of data, revenue, profits, business opportunities, or goodwill, even if such losses are foreseeable or ThriveTools OPT has been advised of the possibility of such damages. By using ThriveTools OPT, you agree that any disputes, claims, or controversies arising out of or relating to these Terms, your use of the platform, or any related services shall be exclusively resolved through the state or federal courts located in Pittsylvania County, Virginia. You waive any objections to the venue or jurisdiction of these courts, including objections based on inconvenience. For users located outside of the United States, you acknowledge and agree that your use of the platform may subject you to the laws and jurisdiction of the United States and the Commonwealth of Virginia. ThriveTools OPT is not responsible for ensuring compliance with local laws or regulations outside of its jurisdiction, and you agree to use the platform at your own risk.
